The App is provided on an "AS IS" and "AS AVAILABLE" basis. We make no warranties, expressed or implied, regarding the reliability, accuracy, or availability of the App. We do not warrant that the App will be uninterrupted or error-free.
To the fullest extent permitted by law, the Midnit Team shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of or inability to access or use the App.
Any dispute, controversy, or claim arising out of or relating to these Terms or the breach, termination, or validity thereof shall be finally settled by binding arbitration. The arbitration shall be conducted in accordance with the rules of the jurisdiction where the Midnit Team is primarily established. You waive any right to a jury trial or to participate in a class action.
These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which the Midnit Team is primarily established, without regard to its conflict of law provisions.
Your use of the App is also governed by our Privacy Policy. By using the App, you consent to the collection and use of your information as outlined in the Privacy Policy.
We may terminate or suspend your account and bar access to the App immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever and without limitation, including but not limited to a breach of the Terms.
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. By continuing to access or use our App after those revisions become effective, you agree to be bound by the revised terms.
